If Lessee accepts damage waiver option, Lessor agrees in consideration of an additional charge of eight percent (8%) of the gross rental charges, to modify Lessee's responsibilities under the section title "Damaged, Lost, Stolen or Dirty Equipment" regarding equipment damaged while in Lessee's possession or control, as described in this section notwithstanding that section. By accepting damage waive, Lessee will not be responsible for damage to, or destruction of the rental equipment or goods, except as follows:
- Loss or damage to accessory equipment such as electric cords, bits and blades.
- Damage due to Lessee's neglect or misuse, or any act or omission of Lessee, its employee or agents, whether or not intentional.
- Loss by theft, mysterious or unexplained loss or disappearance.
- Lessee agrees to furnish Lessor (when requested) a police report on all losses or damage to which this Damage Waiver modification applies.
- Damage to equipment or accessories while in transport.
- Not applicable on some tools or rental situations.
